The Settlement Process

Iwi demonstrate well-founded grievances against the Crown

  • Iwi and Crown ready and willing to negotiate                                        
- WE ARE HERE -
  • Crown accepts Iwi as a Large Natural Grouping (LNG)
  • Iwi mandate representatives to negotiate with the Crown
  • Crown assesses mandate and decides whether to recognize it.

Stage 2:  Negotiations

·         Iwi and Crown sign Terms of Negotiations

·         Negotiations commence

·         Iwi and Crown agree to Crown settlement offer which is recorded in an Agreements In Principle

·         Iwi discusses post-settlement governance models and adopts an entity in principle

·         Agreed settlement terms recorded in a Deed of Settlement

Stage 3:  Ratifications and Implementation Stage

·         Representatives seek approval for Deed of Settlement and governance entity

·         If ratified, Deed of Settlement signed by Crown and claimants

·         Ratification and establishment of a governance entity for holding and managing the settlement assets

·         If appropriate settlement legislation and implementation of the settlement
